This privacy policy sets out how The Valcourt Group and its constituent companies (“Valcourt” or “we” or “us”) uses and protects any information that you provide, or is collected, when you visit this website. Valcourt is committed to ensuring that your privacy is protected. This privacy policy applies to all individuals who access this site, and your access will only be used in accordance with this privacy policy. This policy describes the personal information Valcourt collects and how Valcourt uses, maintains and, if appropriate under certain circumstances, shares, that personal information.

“Personal information” includes any information that enables us to, directly or indirectly, identify you. This identification may be by reference to any number of identifiers including your name, identification number, location data, online identifier or one or more other factors specific to you. Valcourt Building Services, L.C. (a Virginia Limited Liability Company with offices at 1600 Tysons Boulevard, Suite 950, McLean, Virginia 22102) is responsible for determining how Personal Information is used and so is the “controller” of the Personal Information collected in connection with this website.  

If, however, you engage services from, or communicate directly with, any specific member company of the Valcourt Group, then that specific entity will thereafter become the controller of your Personal Information. This privacy policy applies to all the separate entities that make up the Valcourt Group. 

Please read this privacy policy so you can be fully aware of how and why we are using your information. Valcourt may change this policy from time to time by updating this page. By visiting or accessing this website and/or Valcourt’s services, you acknowledge and agree that you have read and understood this privacy policy.

What we collect  

We collect information that you choose to provide to us including, possibly, your name, job title, company name, contact information including email, postal address and telephone number(s). 

You might provide your Personal Information when subscribing to Valcourt publications, newsletters, email updates, announcements, or other publications, by requesting information about our services, or by engaging with surveys, marketing campaigns or promotional activities. In such cases, Valcourt will ask you to provide such Personal Information as your name, contact details and topics of interest. We will use this information to provide you with the information you have requested or information within your areas of interest, or within areas we think may be of interest to you. You can unsubscribe from this content at any time using the method set out in the “Opting Out of Communications” section below.  

You might also provide your Personal Information to register for various events sponsored by Valcourt, and, in that case, Valcourt will use the information you provide for the purposes of registering you for the event and to contact you regarding the relevant event and future events, as well as Valcourt services. You can unsubscribe from these communications at any time using the method set out in the “Opting Out of Communications” section below. In the case of events, we may also share your Personal Information with event sponsors, presenters, or speakers, but not for compensation.  

If you contract with Valcourt or seek to contract for Valcourt’s services, however, we will collect Personal Information which you may or may not directly choose to provide. This Personal Information will be necessary to perform those services, and necessary for Valcourt to be paid for those services. That information may not only include your contact information (including your name, employer, job title, department, address, email address and telephone number(s)), but also include information required or suggested by law or regulation (such as information required for anti-money laundering compliance), financial and invoice-processing related information, and information needed by us to verify your identity and ensure credit and financial solvency. In the foregoing regard, we may engage third party companies or use third party sources. 

What we do with the information we gather 

We use the information collected to understand your needs and provide you with better service or to perform our obligations to you, including for the following reasons:  

  • For internal record keeping.  
  • To improve our services.  
  • To periodically send promotional emails about new services, special offers or other information which we think you may find interesting (using the email address which you have provided).

By making an application with Valcourt, unless prohibited by applicable law or regulation, you are providing consent to Valcourt to keep your information for a reasonable period of time in order to inform you about current and future vacancies. 

If you communicate with us using our Contact Us page, you will provide your name, email address and phone number. This information will be used to address your requests or comments, or to provide you with information you have requested or within areas we think may be of interest to you.  

Additionally, Valcourt’s servers may collect information as a matter of course. This information may include your IP address and operating system. This information will be used to measure site usage, to improve content, to administer the website, for research, for statistical and survey purposes; and 

for system security. 

Disclosing Information to Third Parties 

We will not share, rent, sell or otherwise disclose any personal information that we collect about you except (a) when you request or consent to the release of your Personal Information, (b) to third-party contractors and payment processors who perform services for us in connection with the website or services, (c) to complete a transaction with you, (d) to service providers or suppliers where the disclosure will further technical support for us, and (e) as part of a merger, acquisition or other sale or transfer of the assets or business of Valcourt. We may also disclose Personal Information to comply with the law, court orders or subpoenas, or to protect our rights, property or safety or the rights, property or safety of our users or others. We reserve the right to release information that we collect to law enforcement or other government officials, as we, in our sole and absolute discretion, deem necessary or appropriate.

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, or unlawful or accidental loss, destruction or damage, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.  

Understand, however, that the website runs on software, hardware, and networks which may experience breaches of security beyond our control. Valcourt takes steps to protect your personal information and keep it secure but no data transmission over the Internet or encryption method can be guaranteed to be 100% secure. We cannot and do not guarantee the security of any information you transmit to us, and therefore you use our website at your own risk.

However, once you have used these links to leave our site, you should note that we do not have any control over that other website. How we use cookies

If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible, at the controller address noted above in this policy. We will promptly correct any information found to be incorrect.  

Opting Out of Communications 

If you have subscribed to or are otherwise receiving Valcourt newsletters, news, alerts or other information from us by email and no longer want to receive such information, you may opt-out of receiving these emails by clicking the “unsubscribe” link at the bottom of those emails you receive. Please allow reasonable time for us to process your request. If you are having difficulty unsubscribing, please contact us using the Contact Us page. Please note that even if you opt-out of receiving emails, you may still receive communications related to your interaction with us or otherwise as required by law. Also note that we may need to keep personal information we have collected about you to respect your decision to opt-out, for record-keeping and other purposes.  

Retention 

We will store your Personal Information for no longer than is necessary for the purpose for which the Personal Information is processed. We may retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and rights, or if it is not reasonably feasible to remove it. Subject to the foregoing provisions, we will try to delete your personal information quickly upon request. 

Supplemental Privacy Notice for California Residents 

Effective Date:  11/30/2022 

The following is a Supplemental Privacy Notice ("Supplemental Notice") applicable to persons verifiably residing in the State of California (a "California Resident"). This Supplemental Notice supplements Valcourt’s privacy policy. California Residents, after verification as to identity and California residency, have certain supplemental rights pursuant to the California Consumer Privacy Act of 2018 (the "CCPA"). Any terms defined in the CCPA have the same meaning when used in this Supplemental Notice. 

California Residents have the right to request and receive disclosure of our personal information collection practices during the prior 12 months, including: 

(a) the categories of personal information we collect; 

(b) the categories of sources of such information; 

(c) our business purpose for collecting or sharing personal information; and  

(d) the categories of third parties who we share information with. 

California Residents have a further right to request and receive: 

(a) a copy of the personal information we have collected about them during the prior 12 months; 

(b) disclosure of our information sharing practices during the prior 12 months, including a list of the categories of personal information sold with the category of third-party recipients and a list of the categories of personal information that we disclosed for a business purpose. 

California Residents have a further right to request: 

(a) that we not sell personal information about them; and 

(b) that we delete (and direct our service providers to delete) their personal information subject to certain provisions and exceptions. 

We will only disclose Personal Information to unaffiliated third parties as set forth in the Valcourt privacy policy and in this Supplemental Notice. Valcourt does not sell, rent, trade or share Personal Information with third-parties for their own marketing purposes. If Valcourt was to commence doing so, we will provide an opt out right to California Residents.

Our privacy policy lists the type of data we collect and the sources from which we collect data. It also lists how we will collect, use, and disclose your Personal Information in accordance with applicable law and to whom and under what circumstances we will share Personal Information with third parties. 

(B) California Privacy Rights 

1.   Your Right to Request Information about our Use of Your Personal Information  

Under the CCPA California Residents have the right to request and obtain from us twice a year, free of charge (under most circumstances), information related to Personal Information we have collected in the 12 months preceding the request, including the categories of Personal Information collected, the categories of sources from which the Personal Information is collected, the specific pieces of Personal Information we have collected, the business or commercial purpose for collecting Personal Information, the categories of Personal Information that we disclose to third-parties and the categories of third-parties with whom we share Personal Information.

As permitted by the CCPA, any request a California Resident submits to us is subject to an identification and verification process. We will ask you for information that allows us to reasonably verify your identity and we will use that information only for that purpose. We may request that you submit a signed statement under penalty of perjury that you are the individual you claim to be.   

We will not fulfill a CCPA request unless the requestor has provided sufficient information for us to be satisfied that the requestor is a California Resident about whom we have collected applicable Personal Information.  

We will make commercially reasonable efforts to identify relevant Personal Information that we collect, use, store, disclose, or otherwise process and to respond to California Resident's requests.  

Please also note we are not obligated to comply with a request to the extent that doing so would infringe on our, or any other person's or party's rights, or conflict with applicable law. 

2. Right to Request Deletion of Personal Information 

California Residents have a right to request the deletion of Personal Information that we collect or maintain about them.

Please specify the personal information about you that you would like to have deleted, which might be all of your personal information as required by the CCPA. 

For requests for deletion of your information we may retain certain information and not to delete it under certain circumstances.   

Please note that under California law we are not required to delete Personal Information about an individual that was not collected directly from that individual. 

3. Non-Discrimination 

We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights. 

  

4. Time Frame for Response 

You may make a request for disclosure of our information collection practices, the information we collected about you, or our sharing practices up to twice within a 12-month period.  You may make a request that we not sell information or for deletion of your information at any time. 

We will acknowledge receipt of your request within 10 days and will attempt to respond within forty-five days of receipt of your request, but if we require more time (up to an additional forty-five days) we will notify you of our need for additional time. California Residents are limited to two requests to know/access their personal information within a 12-month period. 

For requests that we not sell your information we will comply with your request within 15 days. We cannot respond to your request or provide you with personal information if we cannot verify your identity and confirm that the personal information relates to you. 

5. Shine the Light Act  

We may disclose your personal information to our affiliates or other related third parties for their use in marketing to you. Pursuant to California’s “Shine the Light Act,” California residents are permitted to request information about the manner in which we share certain categories of information with third parties for their marketing use.
